Article 1: General provisions
bbconcept.site is the e-commerce website of BB Concept,
VAT BE 0542360256, (“BB CONCEPT”). This website offers its customers the opportunity to pur-chase the products from its online store online.
These Terms and Conditions (“Terms”) apply to any order that is placed by a visitor to this e-commerce website (“Customer”). When placing an order via the BB Concept Webshop, the cus-tomer must accept these conditions expressly, with which he agrees to the applicability of these conditions, to the exclusion of all other conditions. Additional conditions of the customer are ex-cluded, except if they have been accepted in advance, in writing and expressly by BB CONCEPT.
Article 2: Price
All prices mentioned are expressed in EURO, always excluding VAT and excluding all other taxes required to be paid by the customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The price indication refers only to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website are composed with the ut-most
care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. Mistakes and/or errors in the offer do not bind BB CONCEPT.
As regards the correctness and completeness of the information provided, BB CONCEPT is only bound to an obligation of means. BB CONCEPT is by no means liable in case of manifest material errors, typesetting or printing errors. When the Customer has specific questions about eg sizes, color, availability, delivery deadline or delivery method, we request the Customer to contact our customer service in advance.
The offer is always valid while stocks last and can be adjusted at any time or withdrawn by BB CONCEPT. BB CONCEPT cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
Article 4: Online purchases
How to place an order?
– You choose your favorite items and place them in your shopping cart.
– To complete the order, click on “Shopping cart” at the top right and go through the following steps in the ordering process:
– Enter your personal details or log in if you are already registered.
– Choose the delivery method: at home, with family or friends, at work, …
– View your details one last time and finalize the order.
– After completion, the order will be confirmed by email and processed carefully.
BB CONCEPT is entitled to refuse an order due to a serious shortcoming of the customer with re-gard to orders involving the customer or when the amount of the order is too small.
Article 5: Delivery and implementation of the agreement
The delivery of the ordered article takes place at an address specified by the customer. BB CON-CEPT strives to deliver the ordered item within 14 working days. However, this delivery time is only indicative. A strict delivery time cannot be guaranteed.
Items ordered through this web store are supplied by an external carrier.
– The goods are only packed and / or shipped after the payment has arrived on our account.
– Deliveries are only made on working days
– The shipments are delivered by an external carrier.
– You will be charged for any costs for returning to our address. Any visible damage and / or quali-tative shortcoming of an article or other shortcoming on delivery must be reported immediately by the customer on the carrier’s shipping documents and to BB CONCEPT. The risk of loss or dam-age is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically acquired the goods. However, the risk already transfers to the customer upon delivery to the carrier, if the carrier has been instructed by the customer to transport the goods and this choice was not offered by BB CONCEPT.
Article 6: Retention of title
The delivered items remain the exclusive property of BB CONCEPT until full payment by the cus-tomer. If necessary, the customer undertakes to inform third parties of BB CONCEPT’s retention of title, eg to anyone who would seize the items that have not yet been paid in full.
Article 7: Right of withdrawal
The provisions of this article only apply to customers who, in their capacity as consumers, pur-chase articles online from BB CONCEPT. The customer has the right to withdraw from the contract within 14 calendar days without giving any reason.
The withdrawal period expires 14 calendar days after the day on which the customer or a third par-ty designated by the customer, who is not the carrier, physically takes possession of the good.
To exercise the right of withdrawal, the Customer must notify BB CONCEPT (email@example.com, Tel: +32 (0) 9/365 64 30, Address: Wijngaardveld 16, 9300 Aalst) by an unambiguous statement (e.g. in writing by post , fax or e-mail) of his decision to withdraw from the contract. The customer can use the attached model withdrawal form for this, but is not obliged to do so.
To comply with the withdrawal period, the customer must send his notice of his exercise of the right of withdrawal before the withdrawal period has expired. The customer must return or hand over the goods to BB CONCEPT immediately, but in any event no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to BB CONCEPT. The customer is on time if he returns the goods before the period of 14 calendar days has expired. The direct costs of returning the goods will be paid by the customer. The costs are estimated at a maximum of approximately EUR 50.
If the returned product is in any way diminished in value, BB CONCEPT reserves the right to hold the customer liable and to claim damages for any depreciation of the goods resulting from the cus-tomer’s use of the goods which goes beyond what is necessary to establish the nature, character-istics and functioning of the goods.
Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back. If the customer revokes the agreement, BB CONCEPT will refund all payments received from the customer up to that time, including the standard delivery costs, to the customer within a maximum of 14 calendar days after BB CON-CEPT has been informed of the customer’s decision to to revoke the agreement. For sales con-tracts, BB CONCEPT can wait with the refund until he has received all the goods back, or until the customer has demonstrated that he has returned the goods, whichever comes first.
Any additional costs resulting from the customer’s choice for a delivery method other than the cheapest standard delivery offered by BB CONCEPT will not be refunded. BB CONCEPT will reim-burse the customer with the same payment method with which the customer made the original transaction, unless the customer has explicitly agreed otherwise; in any case, the customer will not be charged for such refund.
The customer cannot exercise the right of withdrawal for:
– the supply or provision of goods or services whose price is subject to fluctuations in the financial market on which BB CONCEPT has no influence and which may occur within the withdrawal peri-od;
– the delivery of goods manufactured according to the Customer’s specifications, or which are clearly intended for a specific person;
– the delivery of goods that spoil quickly or with a limited shelf life;
– the supply of sealed goods that are not suitable for return for reasons of health protection or hy-giene and of which the seal has been broken after delivery;
– the supply of goods which, by their nature, are irrevocably mixed with other products; agree-ments whereby the customer specifically requested BB CONCEPT to visit him to perform urgent repairs or maintenance there;
– the supply of sealed audio and sealed video recordings and sealed computer software of which the seal has been broken after delivery;
– the supply of newspapers, magazines or magazines, with the exception of contracts for a sub-scription to such publications;
Article 8: Warranty
Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has statutory rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty is without prejudice to these rights. To invoke the warran-ty, the customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the customer’s home, the customer should contact BB CONCEPT customer service and return the item to BB CONCEPT at his expense. If a defect is found, the customer must inform BB CONCEPT as soon as possible. In any case, any defect must be reported by the customer within a period of 2 months after it has been determined. Afterwards, any right to repair or replacement lapses. The commer-cial and / or legal warranty never applies to defects arising from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to follow the operating instruc-tions or manual, modifications or changes to the product. the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, or if applicable date of delivery, are deemed not to be hidden defects, except if the customer can prove otherwise.

Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights that BB CONCEPT has, the customer is, in the event of non-payment or late payment from the date of the default, by operation of law and with-out reminder, required to pay interest of 10 percent per year on the unpaid amount. In addition, the customer is legally and without reminder bound to owing a fixed compensation of 10 percent on the amount involved, with a minimum of 25 euros per invoice. Notwithstanding the foregoing, BB CONCEPT reserves the right to take back unpaid or fully paid items.
Article 11: Privacy
The data controller, BB CONCEPT respects the Belgian law of 8 December 1992 regarding the protection of private life in the processing of personal data.
The personal data provided by you will only be used for the execution and processing of the or-ders, the management of our customer file and the sending of direct marketing, in the sense that the customer file is used by us to keep our customers informed of promotions and novelties and to send the customer personalized offers.
You have a legal right to inspect and possibly correct your personal data. Subject to proof of iden-tity (copy of identity card), you can obtain a written notification of your personal data free of charge by means of a written, dated and signed request to BB CONCEPT.
If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant. In case of use of data for direct marketing: You can object free of charge to the use of your data for direct marketing. For this you can always contact BB CONCEPT, email@example.com, +32 (0) 9/365 64 30. We treat your data as confidential information and will not pass it on, rent it or sell it to third parties. The customer is responsible for keeping his login details confidential and the use of his password. Your password is stored encrypted, so BB CONCEPT does not have access to your password.

Article 13: Affect of validity – non-renunciation
If a provision of these conditions is declared invalid, illegal or void, this will in no way affect the va-lidity, legality and applicability of the other provisions. Failure at any time by BB CONCEPT to en-force or exercise any of the rights set forth in these Terms will never be construed as such and will never affect the validity of those rights.
Article 14: Change of conditions
These conditions are supplemented by other conditions that are explicitly referred to, and the general conditions of sale of BB CONCEPT. In the event of a conflict, the present terms and con-ditions prevail.
Article 15: Evidence
The customer accepts that electronic communications and backups can serve as evidence.
Article 16: Applicable law – Disputes
Belgian law applies, with the exception of the provisions of private international law on applicable law.
The courts of the consumer’s domicile are competent in legal disputes. Consumers can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/). BB CONCEPT has endorsed the Regu-lations of the UNIZO e-commerce label. These regulations are available at http://www.unizo.be/ecommercelabel/ where you can also go to settle complaints or disputes out of court through the UNIZO complaints procedure.
